Introduction

Plucky Knitter, Inc. (“us,” “we,” or “our”) is a family-run business located in Hastings, Michigan U.S.A., dedicated to creating hand-dyed yarns in unique, one-of-a-kind artisan colors on custom luxury bases. We operate the website www.thepluckyknitter.com and the Plucky Knitter mobile application for iOS and Android. For convenience, our website and mobile application may both be referred to in this privacy policy as the “Site.” The Site allows our customers to purchase our yarns and patterns and subscribe to our newsletter. We also conduct email messaging, marketing programs, contests, or sweepstakes on our Site (“Promotional Programs”).

We respect your privacy and want to protect your personal information. Please read this privacy policy to learn more.

This privacy policy explains:

  • How we collect, use, and under certain conditions disclose your personal information.
  • The steps we’ve taken to secure your personal information.
  • Your options regarding the collection, use, and disclosure of your personal information.

We collect personal information on our Site and through our Promotional Programs. This privacy policy applies to our collection of personal information by those means. But it does not apply to retail-partner websites linked to the Site, including Ravelry (www.ravelry.com), Etsy (www.etsy.com), Instagram (www.instagram.com), and PayPal (www.paypal.com). In addition, we have a Facebook page. These websites are not owned or operated by us or under our control (except for certain content that we may provide to Ravelry and Facebook). Ravelry, PayPal, Etsy, and Facebook have their own privacy policies. You may want to review the privacy policies of these sites, including their related mobile applications, and how they collect and use your personal information. Additionally, your use of the Site is subject to our Terms & Conditions of Use, including its choice of law, damages limitation, and dispute resolution provisions.

Privacy and Security

Except as described in this policy or as otherwise required by law, we will not sell or disclose your personal information to anyone. Personal information includes your contact information and other personal information required to process your orders or request services from us so that we can provide you with products or services. We also communicate with you to answer your questions related to those products and services and send you marketing materials, subject to applicable laws and this privacy policy.

One goal in collecting your personal information on our Site is to provide a customized, efficient, and meaningful experience. For example, we may use your personal information to:

  • Help make our Site easier for you to use by not having to enter information more than once.
  • Help you quickly find information, products, and services.
  • Help us create content that is most relevant to you.

What Personal Information Do We Collect on Our Site?

  • Log Files. As is true of most websites, our web server automatically recognizes the internet URL from which you access our Site. We may also log your internet protocol (IP) address that may indicate the location of your computer on the internet), internet service provider, and date/time stamp for system administration, order verification, internal marketing, and system troubleshooting. But IP addresses are not used to track a user’s session. This information only helps us determine how often different areas of our Site are visited. We don’t link IP addresses to any personally-identifiable information.
  • Email Addresses. We do collect personal information consisting of the names and email addresses of those who communicate with us via email, sign-up to receive our newsletter, or submit content to user-generated content areas, and information that customers volunteer, such as survey information and the information provided to participate in a Promotional Program. You may also choose not to provide this information, but then you won’t be eligible to receive the requested Promotional Program or other service.
  • When you order products on our Site, we collect additional personal information, including your name, address, and “ship-to” name and address, if different than your name and address. This personal information is used for billing purposes, to fulfill your order, to communicate with you about your order, and for internal marketing purposes. If we encounter a problem with processing your order, we may use your personal information to contact you.

Please note: we don’t collect, store, or have access to your credit card information,
including account numbers, CVV numbers, or card expiration dates.

Cookies and Other Technology. Like many websites, we collect information about you when you visit the Site, such as the pages you visit and product information that you view. We may do this by cookies, flash cookies, pixel tags (also called clear gifs, web beacons, or web bugs), or iFrames. We or our partners may place these cookies, flash cookies, pixel tags, or iFrames on the Site.     Apart from the uses described below, we have the right to any information that our Site collects. We may freely use and disclose that information unless prohibited by this privacy policy or applicable law.

    • Internal Use. We may use your personal information to:
      • Process your order and provide you with customer service.
      • Improve our Site’s content and layout.
      • For our own marketing efforts and customer outreach.

    About the Voluntary Submission of Personal Information

But we may need to retain it for legally-permitted purposes, and we may also retain de-personalized information after honoring your request.     Retention of Personal Information

    We will retain personal information that we collect, access, or process only as long as necessary for the fulfilment of the purposes for which it was collected, unless otherwise provided in agreements between us or as required or authorized by law. We will destroy, erase, or de-identify personal information that is no longer required to fulfill the purposes for which it was collected.

    Data Security

    The Site incorporates reasonable and appropriate physical, electronic, and administrative procedures to safeguard the confidentiality of your personal information, including Secure Sockets Layer (SSL) for all financial transactions made through the Site. We use SSL encryption to protect your personal information online, and we also take several steps to protect your personal information in our facilities. Access to your personal information is restricted. Only employees who need access to your personal information to perform a specific job are granted access to your personal information. Also, we rely on our third-party service providers for the physical security of some of our computer hardware. We believe that their security procedures are adequate.     No Data Security Guarantee

    ►While we use industry-standard precautions to safeguard your personal information, we cannot guarantee complete security. 100% complete security does not presently exist anywhere online or offline.

    ►It is important for you to protect against unauthorized access to your computer. Be sure to sign off when finished using a shared or public computer.

    ►We also suggest that you install and run anti-virus and malware detection software programs on your devices and keep those programs current. 

    Opt-Out

    At your request, we will (a) stop sending emails to your email address; or (b) disable your account to prevent any future purchases through that account.     Offline Collection, Use, and Disclosure of Information

    As you might expect, most of information that we collect is obtained through the Site, and this privacy policy applies only to that online collection of personal information. We also try to protect the privacy of your personal information that we may collect offline. One example involves someone calling us for help in placing an order or to ask questions. When that happens, we will ask only for the personal information that we need to assist in placing the order or answer the question. When we need to store information, we will enter it into our database through SSL encryption (see Data Security above for more information). There are other ways we could learn of personal information offline (for example, someone could send us a letter that includes return address information), and this privacy policy doesn’t discuss or try to predict all of those methods. But we’ll try to treat offline collection, use, and disclosure of personal information consistently with our online practices.

    International

    Your personal information may be stored and processed in the U.S. or any other country in which we or our service providers maintain facilities. By using the Site‚ you consent to the transfer of information to countries outside of your country of residence‚ including the U.S.‚ which may have different data protection rules than in your country. This Site is controlled and operated by us from the United States and is not intended to subject us to the laws or jurisdiction of any state‚ country, or territory other than that of the United States.

    What About the Privacy Rights of Children?

    Just like you, we’re especially aware of children’s privacy issues. We know that parents are justifiably concerned about their children’s activities online and what’s being done with the information they reveal. That’s why we will never intentionally collect information from children under 13, except for email addresses used only for reply purposes. If we learn that we have collected personal information from a child under age 13, we will promptly delete that information.     Your California Privacy Rights:

    This privacy policy generally describes how we share information for marketing purposes. Under Section 1798.83 of the California Civil Code, California residents have the right to request from a business, with whom the California resident has an established business relationship, certain specific information about the types of personal information that the business shares with third parties for direct marketing purposes by the third party and the identities of the third parties with whom the business has shared that information during the immediately preceding calendar year.

    Under Section 17538 of the California Business and Professions Code, residents of California, U.S.A who are involved in internet transactions have the right to know certain information. This information as it applies to your transactions on our Sites is:
